These Terms of Service ("Terms") govern your use of Novalistic.AI LLC's ("Company", "we", "us") AI chatbot development, automation, and related Services.
By purchasing or using our Services, you agree to these Terms.
We provide AI chatbot design and development, automation workflows, API integrations, chatbot hosting and maintenance, conversational AI configuration, and Voiceflow/OpenAI-based implementations.
Clients agree that they will not use the Services for unlawful, harmful, or deceptive purposes. They will not upload sensitive data (medical, financial, government IDs, etc.) unless explicitly agreed. They are responsible for complying with all applicable laws related to their use of the chatbot and hold the rights to any content uploaded or provided to us.
Some Services rely on third-party platforms (e.g., Voiceflow, OpenAI). By using our Service, you acknowledge that third-party tools may process user data, their privacy, uptime, or security policies apply, and we are not responsible for failures, outages, or breaches caused by third-party providers.
AI responses may be inaccurate, incomplete, or outdated. AI-generated content should not be considered legal, financial, medical, or professional advice.
You acknowledge that you are solely responsible for reviewing and validating the content generated by the AI systems.
Custom chatbot designs, flows, and configurations delivered to you become your property upon full payment. Underlying software, frameworks, and proprietary development tools belong to the Company.
Payments are due based on the agreement or invoice. Late payments may result in service suspension. Refunds are not guaranteed unless specified in a written agreement.
To the fullest extent permitted by law:
We are not liable for any indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid for the Services in the previous 30 days. We are not responsible for data loss, business loss, revenue loss, or errors generated by AI models.
Our Services are provided "as is" without warranties of any kind, including accuracy, reliability, or availability.
We may suspend or terminate your access if you violate these Terms, fail to pay, or misuse AI tools or upload prohibited content. Upon termination, data may be deleted at our discretion.
These Terms are governed by the laws of the State of North Carolina, United States. Any disputes shall be resolved in the courts of North Carolina.
