By accessing our website, using our services, submitting information, requesting a consultation, or communicating with us through web chat, SMS, voice, or email, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. Our Services

Novalistic.ai provides AI-powered lead response, follow-up, missed-call recovery, and booking systems for appointment-driven service businesses. Users may request consultations, communicate with AI assistants, receive follow-ups, and continue conversations across supported channels.

Unless expressly stated in a separate written agreement, we do not guarantee specific business outcomes, lead volume, conversion rates, or booked-appointment results.

4. AI-Generated Responses

Our services may use AI to generate responses, summarize information, classify requests, and support booking conversations. AI outputs may be incomplete or inaccurate. Confirm scheduling, pricing, and service decisions with the relevant business or a qualified professional.

5. No Guarantee of Results

Lead estimates, response-time targets, and booking projections are not guarantees of revenue, conversion rates, or appointment volume. Results depend on factors outside our control.

6. User Responsibilities

You agree to:

• Provide accurate information when requesting a consultation or support
• Use the services only for lawful purposes
• Maintain confidentiality of any credentials or secure links provided to you
• Comply with applicable laws, carrier messaging rules, and these Terms
• Obtain required consent before using our platform to message end customers, if you are a business customer of Novalistic

7. Voice Calls and Recording

Calls may be recorded, transcribed, monitored, or analyzed for quality, training, security, compliance, and support. Where required by law, we will provide notice or obtain consent before recording.

8. Prohibited Use

You may not use our services to:

• Submit false, misleading, fraudulent, or unauthorized information
• Impersonate another person or misrepresent your identity or authority
• Interfere with, disrupt, reverse engineer, scrape, or overload our systems
• Send spam or messages without required consent
• Bypass security, consent, authentication, or messaging compliance controls
• Upload malware or content that infringes the rights of others

9. Third-Party Services

Our services may depend on third-party providers, including Twilio and Telnyx for SMS, MMS, voice, and communications infrastructure; AI providers; CRM and scheduling tools; and hosting, analytics, email, and security vendors.

Third-party providers have their own terms and privacy practices. We are not responsible for carrier or network delays, message delivery failures, or actions taken by partners outside our control.

10. Intellectual Property

The Novalistic.ai name, website, software, content, and related technology are owned by Novalistic.ai or its licensors. You may not copy, modify, distribute, sell, or create derivative works from our services except as expressly permitted in writing.

You retain ownership of information you submit, but grant us a limited right to use that information to provide, secure, improve, and operate the services and to communicate with you as described in these Terms and our Privacy Policy.

Our collection, use, storage, and sharing of personal information — including mobile numbers and SMS consent — is described in our Privacy Policy.

12. Termination

We may suspend or terminate access if you violate these Terms, create risk, misuse communications channels, or use the services unlawfully. You may stop using the services at any time and may opt out of SMS by replying STOP.

The services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

14. Limitation of Liability

To the maximum extent permitted by law, Novalistic.ai and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost business, missed appointments, or service interruptions arising from your use of the services.

15. Arbitration and Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law rules. Any dispute arising from these Terms or the services will be resolved through binding arbitration on an individual basis, unless applicable law gives you a non-waivable right to proceed in court.

You and Novalistic.ai agree to bring claims only in an individual capacity and not as a class, collective, consolidated, or representative action, to the extent permitted by law.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the services after updated Terms are posted means you accept the updated Terms.
